By accessing this website, purchasing or enrolling in a course, creating an account, or using any services provided by Brian Koster, LLC d/b/a EmpowerED Professional Learning ("EmpowerED Professional Learning," "EmpowerED PL," "we," "our," or "us"), you agree to be bound by these Terms & Conditions.

If you do not agree to these Terms & Conditions, you should not use our website, create an account, purchase a course, enroll in a course, or use our services.

EmpowerED Professional Learning is operated by Brian Koster, LLC d/b/a EmpowerED Professional Learning.

We provide online professional learning experiences for educators, schools, and districts, many of which include personalized instructor feedback. We also provide online test-preparation and educational services for eligible learners.

EmpowerED PL test-preparation services are intended for learners age 13 and older. Children under age 13 may not create an account, enroll in a course, purchase a course, or use our test-preparation services.

If you are between the ages of 13 and 17, you may use eligible EmpowerED PL services only to the extent permitted by applicable law and by the terms or requirements of the payment provider, learning platform, school, educational institution, or other service involved.

If a parent or legal guardian purchases a course for a minor learner, the parent or guardian is responsible for ensuring that the learner is eligible to use the service and complies with these Terms.

By creating an account or using our services, you represent that the information you provide regarding your eligibility is accurate.

EmpowerED PL courses are delivered digitally through the Moodle learning platform. Unless otherwise stated on the applicable course page, a course purchase includes 365 days of access beginning on the date of enrollment.

Courses may include videos, presentations, downloadable resources, activities, practice sets, quizzes, assessments, study guides, templates, feedback, certificates, or other digital materials depending on the course.

Not every course includes every type of resource, certificate, assessment, instructor interaction, or other feature. The applicable course page and syllabus describe the components of that particular offering.

EmpowerED PL uses MoodleCloud to provide online course access and learning activities.

By using MoodleCloud, you may also be required to accept and comply with MoodleCloud or Moodle policies, terms of service, privacy notices, cookie policies, or other applicable platform requirements.

EmpowerED PL does not control all features, technical operations, availability, or policies of MoodleCloud. Temporary outages, maintenance, platform changes, or other third-party technical issues may affect course access.

If a platform issue materially prevents access to a purchased course, contact us at info@empoweredpl.com so that we can review the issue and provide appropriate assistance.

User accounts are licensed to one individual learner unless an institutional or group arrangement expressly provides otherwise.

Sharing usernames, passwords, course access, or account credentials with another person is prohibited.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You agree to provide accurate account information and to notify us if you believe your account has been accessed without authorization.

Payment is required before access to paid courses or products is granted unless another arrangement has been approved in writing.

Prices are listed on the applicable course or product page and may change without notice. Price changes do not affect purchases already completed.

Payments may be processed through Stripe or another disclosed third-party payment provider. Payment providers maintain their own terms, privacy policies, security practices, and eligibility requirements.

EmpowerED PL does not store full payment card numbers on its website or learning platform.

A parent, guardian, school, district, institution, or other authorized purchaser may purchase access for an eligible learner when permitted by the applicable payment and enrollment processes.

Refund requests are governed by our Refund & Returns Policy.

By purchasing a course or digital product, you acknowledge that you have reviewed and agree to the Refund & Returns Policy applicable to that purchase.

Some EmpowerED PL professional learning courses offer certificates of completion or documented professional development hours. Other offerings, including test-preparation courses, may not.

When a course offers a certificate, the certificate is awarded only after successful completion of the requirements identified for that course.

EmpowerED Professional Learning does not guarantee that professional development hours, certificates, or course completion will be accepted by any employer, school district, state licensing agency, certification board, college, university, or other organization.

Participants are responsible for verifying whether a course satisfies professional development, certification renewal, licensure renewal, salary advancement, continuing education, graduate credit, or other requirements before enrolling.

Unless expressly stated otherwise, professional development hours are not college or graduate credit, semester hours, continuing education units, certification, or licensure.

EmpowerED PL test-preparation courses are educational study resources designed to help learners review skills, concepts, strategies, and question types associated with particular examinations or assessments.

Test-preparation courses do not constitute official testing, official scoring, admission decisions, placement decisions, certification, licensure, academic credit, or any other official determination by a testing organization, school, college, government agency, or other third party.

Practice questions, quizzes, assessments, worked examples, and other instructional materials created by EmpowerED PL are for preparation and instructional purposes. Unless expressly identified otherwise, they are original EmpowerED PL materials and are not official, retired, released, licensed, or endorsed test questions.

Performance within an EmpowerED PL course should not be interpreted as a prediction or guarantee of performance on an official examination.

EmpowerED PL does not guarantee that use or completion of a test-preparation course will result in a particular score, passing result, college-readiness designation, placement decision, admission decision, exemption, certification, licensure result, scholarship decision, academic outcome, or other result.

Official testing requirements, scoring standards, eligibility rules, placement standards, examination content, and policies are determined by the applicable testing organization, educational institution, government agency, certification body, or other responsible entity and may change.

Learners are responsible for confirming current official requirements with the organization responsible for the examination or decision.

Unless expressly stated otherwise, EmpowerED Professional Learning is an independent educational and test-preparation provider.

EmpowerED PL is not affiliated with, sponsored by, endorsed by, approved by, or operated by any testing organization, government agency, school system, college, university, certification body, or other organization merely because one of our courses prepares learners for an examination, assessment, certification, or educational requirement associated with that organization.

Names of examinations, programs, agencies, institutions, or organizations may be used solely to identify the subject of the preparation service or to describe the examination or requirement for which the course is designed.

Any third-party trademarks, service marks, or names remain the property of their respective owners.

EmpowerED PL strives to provide accurate and current information about examinations, scoring standards, skills, policies, and other test-related requirements based on information reasonably available when course materials are prepared or updated.

Testing organizations, government agencies, educational institutions, and other responsible entities may revise their examinations, policies, scoring standards, eligibility requirements, or procedures without notice to EmpowerED PL.

Official information from the organization responsible for an examination or requirement controls if it differs from information presented in an EmpowerED PL course.

All videos, presentations, downloadable resources, templates, study guides, practice questions, quizzes, assessments, graphics, written materials, course design, and other original course content remain the intellectual property of Brian Koster, LLC d/b/a EmpowerED Professional Learning unless otherwise indicated.

You may download resources specifically made available for download for your own personal study, professional use, or classroom use, as applicable to the course.

Materials may not be copied, shared, redistributed, posted publicly, uploaded to file-sharing services, resold, republished, reproduced for other learners, used to create competing educational products, or otherwise distributed without prior written permission.

Purchasing a course grants you a limited right to access and use the course for its intended purpose. It does not transfer ownership of the course materials or intellectual property.

EmpowerED PL course materials may not be uploaded into artificial intelligence systems for redistribution, commercial reuse, model training, creation of derivative commercial materials, generation of competing educational products, or other unauthorized use without prior written permission.

This restriction does not prohibit ordinary personal use of an approved technology when a course activity expressly directs or permits the learner to use that technology.

Learners are expected to complete required course assessments and activities honestly and in accordance with the directions provided.

You may not obtain, distribute, publish, copy, reproduce, sell, or share answer keys, protected assessment content, quiz questions, final assessment questions, or other restricted course materials except as expressly permitted by EmpowerED PL.

You may not use another person to complete required course work on your behalf or complete required course work on behalf of another learner.

You agree not to misuse this website, Moodle learning environment, courses, or related services.

Prohibited conduct includes attempting unauthorized access, sharing accounts, interfering with website or platform operations, introducing malicious software, circumventing security controls, violating intellectual property rights, harassing or abusing others, submitting unlawful material, or using our services for fraudulent or unlawful purposes.

Schools, districts, colleges, educational programs, employers, and other organizations may purchase or arrange course access for eligible learners or participants.

Additional purchase orders, contracts, data agreements, license terms, enrollment limits, or other written agreements may apply to institutional purchases.

If a separate written agreement between EmpowerED PL and an institution conflicts with these Terms regarding that institution’s purchase or users, the applicable written agreement will control to the extent of the conflict.

EmpowerED Professional Learning reserves the right to improve, revise, update, replace, or remove course content, videos, downloadable resources, activities, quizzes, practice questions, assessments, or other materials to maintain instructional quality, accuracy, relevance, security, or alignment with current requirements.

Course updates do not extend the original enrollment period unless explicitly stated.

We may also discontinue a course or product. When reasonably practicable, we will seek to avoid materially disrupting active paid enrollments.

Courses or website pages may contain links to resources, websites, policies, publications, tools, or services operated by third parties.

EmpowerED PL does not control third-party websites or services and is not responsible for their availability, content, privacy practices, security, accuracy, or terms.

The inclusion of a link or reference does not necessarily imply endorsement, affiliation, sponsorship, or approval.

We reserve the right to suspend or terminate access to courses, accounts, or services when these Terms are materially violated, including unauthorized sharing of accounts or course materials, misuse of assessment content, fraudulent activity, misuse of the website or learning platform, or unlawful conduct.

Where appropriate, we may provide notice or an opportunity to correct a violation before terminating access, but we reserve the right to act immediately when reasonably necessary to protect users, intellectual property, systems, security, or legal rights.

Courses, test-preparation materials, professional learning, website content, and educational resources are provided for educational and informational purposes.

While we strive to provide accurate, current, practical, and evidence-informed content, EmpowerED Professional Learning does not guarantee that course content will be complete, error-free, continuously available, accepted by every employer or institution, or applicable to every learner, educational setting, examination administration, or jurisdiction.

Except as required by applicable law, all courses, website content, downloadable resources, and services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied.

To the fullest extent permitted by applicable law, Brian Koster, LLC d/b/a EmpowerED Professional Learning shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the website, courses, learning platform, digital products, or services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Our collection and use of personal information is described in our Privacy Policy.

By using our services, you acknowledge that course delivery, payment processing, and other functions may also involve third-party services such as MoodleCloud and Stripe, which have their own privacy policies and terms.

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

We may update these Terms & Conditions periodically as our services, technology, legal obligations, or business practices change.

Updated Terms become effective when posted unless a different effective date is stated.

Continued use of the website or services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
